Terms and conditions of use for COOL MOVE services

1. Acceptance of Terms:

By using COOL MOVE services, external event or use of our facilities, the user fully accepts the terms and conditions set forth in this document. These terms constitute a legally binding agreement between the user and COOL MOVE.

2. Description of Services: COOL MOVE offers contrast therapy services (saunas and cold plunges) in different modalities, including private events and bath rentals. Regardless of the chosen modality, these terms and conditions will apply in their entirety. The user acknowledges that cold water therapy involves health risks and that it is their responsibility to assess whether they are in adequate physical condition to participate.

3. Risks and Responsibility

3.1. Risks: The user acknowledges that contrast therapy may involve health risks, including but not limited to hypothermia, shock, muscle injuries, and other medical complications.

3.2. Assumption of Risks: The user assumes full responsibility for any injury, damage, or loss that may occur as a result of their participation in COOL MOVE services, regardless of the cause.

3.3. Release of Liability: The user releases COOL MOVE, its employees, agents, representatives, and collaborators from any liability for any damage, loss, or injury, whether direct or indirect, that may arise as a result of using the services. The user agrees to indemnify and hold COOL MOVE harmless from any claims, including legal fees, arising from the user’s breach of these safety terms.

4. User Requirements

4.1. Health Status: By accessing these facilities, you warrant that you are in good physical health and have no medical conditions that make heat or cold exposure hazardous or any other condition that may be aggravated by extreme temperature changes. You expressly acknowledge and agree to the following prohibitions:

For all facilities (hot & cold)

• Pregnancy: Risk of fetal hyperthermia or cold shock.

• Intoxication: No use under the influence of alcohol, drugs, or narcotics.

• Cardiovascular: History of heart attack, stroke, unstable angina, or congestive heart failure.

• Neurological: Epilepsy, history of seizures, or conditions causing fainting/syncope.

• Infection: Active fever, contagious skin conditions, or open/unhealed wounds.

Infrared Sauna (deep tissue heating)

• Implants: Surgical pins, rods, or silicone implants (may absorb/reflect infrared heat).

• Chronic Heat Sensitivity: Multiple Sclerosis (MS), Lupus, or adrenal suppression.

• Circulatory: Hemophilia, chronic bleeding, or peripheral vascular disease.

• Skin Sensitivity: Not recommended for Rosacea, heat-induced urticaria (hives), or acute eczema/psoriasis flares.

• Sensory/Nerve Damage: Including Peripheral Neuropathy or Anhidrosis (inability to sweat).

Finnish Sauna (high heat & humidity)

• Respiratory: Severe asthma, COPD, or acute chest infections.

• Hypotension: Chronic low blood pressure (high risk of fainting).

• Recent Aesthetics: Not recommended within 14 days of Botox, dermal fillers, or chemical peels (heat may cause product migration or irritation).

• Acute Inflammation: Joint or muscle injuries within the last 48 hours.

Cold Water Therapy (Ice Bath/Plunge)

• Cardiac Arrhythmia: Risk of "Cold Shock Response" triggering irregular heartbeats.

• Vascular: Raynaud’s Disease, history of DVT (blood clots), or peripheral artery disease.

• Hypertension: Untreated or unstable high blood pressure.

• Renal Issues: Chronic kidney disease or reduced renal function.

You acknowledge that the list below is not exhaustive and that you are responsible for any condition not listed that may be aggravated by these services. If you experience lightheadedness, dizziness, or physical discomfort, you agree to exit the equipment immediately.

4.2. Medical Consultation: The user agrees to consult with a doctor before using the services, especially if they have any pre-existing medical condition.

5. Use of Facilities

The User agrees to use COOL MOVE facilities safely and responsibly, following staff instructions and established rules.

6. Privacy Policy

COOL MOVE is committed to protecting the User's privacy. Personal information collected will be treated in accordance with our privacy policy.

7. Modification of Terms

COOL MOVE reserves the right to modify these terms and conditions at any time. Modifications will be effective upon publication on our website. Continued use of our services after such modifications constitutes acceptance of the updated terms.

8. Applicable Law and Jurisdiction

These terms and conditions will be governed by Spanish law, and any dispute arising from this contract will be submitted to the Courts and Tribunals of Valencia, expressly waiving any other jurisdiction that may correspond.

9. Use of Images and Videos

By using COOL MOVE services, the User expressly authorises COOL MOVE to take photographs and videos during sessions and to use such images and videos for promotional purposes on our social networks, website, and any other marketing material. The user acknowledges that by participating in the sessions, their image may be captured and used in this manner. If the user does not wish their images or videos to be used for promotional purposes, they must inform COOL MOVE staff before the start of the session. In the event that the User does not communicate their opposition and images or videos are taken, it will be understood that they have given their consent for their use.

10. Complete Agreement

These terms and conditions constitute the complete agreement between the user and COOL MOVE regarding the use of services.
